Law question: Misprint of Expensive Polo Shirt?
Hi, i recently bought a polo shirt (60 dollar ish) for the national badminton team and i decided to get it customized at my local print shop. To my horror, i found out after they were done that they made one of the third lines very very unproportional to the rest of the print and i specifically told them the dimensions beforehand as well. So, i decided to approach the owner and ask him for advice but all he said was :" IT LOOKS fine to me! " and gave me a dirty look. So, after trying to negotiate with him i just gave up and decided that i may try small claims court. I have the original order form with my specifics, the poloshirt, proof of purchase and the original picture that i wanted my tshirt to look like. IF i go to small claims, do you guys think ill win? BTW the business name is People Print and although the employees are very nice, the owner is very rude , unprofessional and unbusinessmanlike.
You certainly can take him to small claims court. If you have all the documents that you said, then you definitely have proof of a contract. You can sue for breach of contract. Did you already purchase a new shirt through someone else?
If you did & you got what you wanted through that company, bring the "good" shirt & that contract with you as well. You can sue for breach of contract & you would (if you win) get back whatever money you are out. You can't recover any extra "damages", the goal of contract law is to make you whole not put you in a better position. In other words, you would get a refund & that's it so if you need to take time off from work to go to court, you should weigh the pros and cons of suing. Also, there is a fee to file ($35 in my state of MA) a small claims case, but usually if you win, you can recover this from the defendant.
If you didn't get the shirt done elsewhere yet, there is another option in contract law called "specific performance" which you can seek as a remedy. What it basically means is that the magistrate (or judge, depending on your state) can order the company to execute the contract. This would force the shop to carry out the original contract without any changes so you would get the shirt as you wanted it for the price that you originally agreed upon.
If you have all the papers, as you say, and the print size that you wanted is in fact clearly expressed & agreed upon; this case would be a slam dunk win for you. Re-read what you have because the magistrate will look at the contractual agreement as WRITTEN, no matter what you guys may have agreed to later VERBALLY.
